What is the name of your state (only U.S. law)? NY

I will try to be brief but give as much detail as possible. I'm looking for someone that knows the process if:
  • there are two people on a property's deed
  • both party's are on the mortgage; borrower & co-signer
  • one party is now deceased (borrower) and left no will
  • one of her children is appointed executrix, post mortem
  • surviving person on the will wants to buy out heirs; who are willing to sell
  • surviving person is in the process of securing financing
  • lawyer for the heirs says he is waiting for some sort of ruling from surrogate court
We are going thru this because the mortgage company stopped all communication once they were notified of the borrower's death and would not even speak with the co-signer.
What is the process and what options does the co-signer have?
