I am based at Fort Campbell KY but case is in West Virginia:

I had a gf that had became pregnant before being deployed to Iraq. After one month in Iraq she had left me to be with another man in West Virginia. Since returning to the states I have found out that this man she had left me for had slept with her the same week of conception. I have also found out from her family members that on her way from KY to West Virginia she had also stopped of at another mans home and had sex with him. The child support office of West Virginia says since I am SUPPOSEDLY the father that I have to cover the baby medically. We are awaiting a paternity test to find out for sure even though I have sent her some money and I even left her in care of ALL my money while deployed so that she and the baby would be taken care of. Basically what I need to find out is WHEN (If I am proven to be the father) AM I RESPONSIBLE FOR THE CHILD SUPPORT. I have 3 other children from a previous marraige and I have custody of 1 of those children. I just really don't want to be sending this woman money IF this child is not mine. WILL THEY CHARGE ME CHILD SUPPORT FROM THE DAY THE BABY WAS BORN?
One more thing... She refuses to allow me to see the child because I would not take her back and I have a new GF now. ONCE PATERNITY IS PROVEN, if I am the father, CAN SHE KEEP ME FROM SEEING THE CHILD BECAUSE I HAVE A GF THAT LIVES HERE?

When paternity is established and you are found to be the father, you will be responsible from birth since this was filed before the child was born.

Yes.

Not for that reason, but you will need to establish custody and visitation regardless of your girlfriend.

This was just filled about 1-2 months ago as far as going through the state.

Will the fact that she recieved around $18,000 while I was deployed and the other money I have sent her for child support(NOT COURT ORDERED) be taken in account for the child support?

I plan on establishing custody and visitations rights, its just because I have a gf she says I can't have the baby around her. I am not even supposed to bring my gf with me to see the baby. REASON WHY I NEED MY GF TO GO WITH ME IS BECAUSE MY EX MOVED TO WV before having the baby and thats A LONG DRIVE ALONE!

Once paternity is not/proved, then you can do several things, If you are the father petition for custody and visitation. The judge will decide the details of both. Insofar a child support, they will take into consideration that you have other children to support as well, that will determine how much is due monthly and since filing. You may have already provided more towards her support than would have been due by the child support calculators. The judge may, make some adjustment based on the fact that you tried to pay and did not know that she was comitting fraud. If you are not the father, you may be able to sue her for paternity fraud.
