Question: When petitioning the court for modification on visitation can one ask for joint legal custody when they go to court?

Generally no, not unless it was included in the original petition for modification or unless new paperwork is submitted to add that as an issue.

Sometimes a judge might allow it to be requested during the hearing...but generally no.

Does your State Forms headers State Petition For Custody/Visitation Modification ?

I would include the request in the Petition anyways .

I filed the petition last week and court is scheduled for Feb. 1st. I'm not sure what the header read. The reason that ask: I'm going to court for modification on visitation after I filed contempt due to denial of visitation with my daughter. She tries to choose which weekends I have her and has denied me all holidays. The agreement states that I have her every other weekend and every other holiday. So, to get to the point I would like to request joint legal custody along with modification due to the fact of visitation denial.

Request the Judge directly to amend the Petition to include a change in Custody , to be Joint Custody . He may or may not allow it , or call the court clerk's to see if there is a way to amend the Petition before the court date .
