My sister & her husband live in Florida. The home they live in is in her huband's name. He has a 21 yr old daughter by a previous marriage. If he passes away without a will, who will the house belong to? My sister, or the daughter he had by a previous marriage?

Check FL's laws of intestate descent. A likely answer is that sis will own 1/2 and step-daughter will own half.

Tell your bro-in-law to make out a will! There are any number of ways he can ensure both his wife's and daughter's inheritances.

Go to the estate planning board for more info.
