In the US, in order to protect an invention, an inventor can file either a regular or a provisional patent application once the invention can be described (how to make it, how to use it). The patent application is filed with the United States Patent and Trademark Office.

Patent procedures and patent protection differ between countries. In India, the country edwardcullen expressed an interest in, the following Office of Controller General of Patents, Designs and Trademarks site provides information on the process involved in applying for and obtaining a patent in India: http://ipindia.nic.in/ipr/patent/patents_filing.pdf

International treaties like the Paris Convention and the Patent Cooperation Treaty and the World Trade Organization allow for a US inventor to apply for patent protection in India and allow for an inventor in India to apply for patent protection in the US.
