My wife and I were married in Nevada. We lived together in California until I moved alone Massachussetts. I have been resident in Massachussetts for 18 months, but am moving to New York city in two weeks. Where should I file for divorce?
My response:
This whole question hinges on State residency requirements, and how fast you want to get the "ball rolling".
Nevada is definately out.
California is out insofar as you are concerned. If your wife wishes to file in California, she can do it there. But, then you're in for many flights back and forth - - unless, of course, it all doesn't matter to you, and you would rather have your "Default" taken.
If it is your desire to get the ball rolling, MA would be the State where you have satisfied the residency requirements. This is your fastest method, but not necessarily your most convenient, as you will soon understand below.
If you file in New York, you must first meet the New York residency requirements of 6 months before filing. But, if time is NOT of the essence, this would be your better choice concidering the fact you are moving there in two weeks. That way, all proceedings will be held there, and you won't find yourself flying back and forth to MA for the proceedings.
There's much more that you need to know, but this should be enough to stir some good questions for you when you see an attorney in your free, initial, consultation. Call a Family Law attorney in MA for further details.
Good luck.
