I apologize if I have posted this in the wrong category as I am not sure where it should go. That is procisely what I have written to ask about.

Picture for a moment a scenario. Say there is an enormously wealthy man who is world renowned for his philanthropy. We will call him Mike Oliver. He is respected in dozens of countries around the world for projects that help economic growth and vastly improve living condition etc. He has an extremely good reputation, for honesty and fairness. What if a group of individuals (totally separate from this philanthropist) formed an organization entitled Mike Oliver’s Banking Service? The name Mike Oliver was intentionally included in the title to project to customers that this bank operated by the same ethics that most of the population had come to expect with the Mike Oliver name. But the name only served to cover up their unethical mode of operation that was just barely on this side of legal. As time progressed customer complaints continued to grow – to a point where Mike Oliver’s reputation was being damaged.

What, in the rights of the law, can be done about this type of situation? What type of fraud/slander is this? And how is it defeated.

Yes, in essence, this is an actual situation - though the name and particulars are representative only. I am asking because I know that the law has addressed this type of cases before but I am unaware of the terminology. If this was Defamation then the plaintiff would have to establish that it was done out of malice. In this case that would be hard to prove since it was done more for the purpose of fraud. However, the result was very much defamation and he is entitled to compensations.

"A defamation is an untrue communication about a person that injures his good name or reputation so that he is subjected to the hatred, abuse, contempt, or ridicule of others. Because it deprives an individual of his right to acquire and enjoy a good reputation, he is entitled to be compensated for this loss."

Any advice you can give in this matter would be much appreciated. Thank you.

IS a spouse entitled to another spouse's workers compensation when the case is settled. Do those funds become marital assets when a divorce has been filed?

The worker's compensation imjury was sustained in eight years prior to the marriage, but took eight years to settle. The funds were dispersed two years ago. we separated the same year I received the funds. Now we're getting a divorce and he's asking for his portion.

Is he entitled to anything? :(
