What is the name of your state (only U.S. law)? Tennessee

I purchased software and hosting online from a company in Arizona

I purchased 10 licenses, used 2 (company uploaded to their server), we did not get actual software as the seller was to upload each one as we needed to build a new site.

The seller/hosting company lost our 2 sites and will not give us the software that we purchased.

We have lost substantial revenue from loosing the sites themselves (development time) and the revenue they created.

Do I have to file a small claims action in Arizona where his office is, or can I fine in Tennessee as he was selling (persued sale) in Tennessee? He does not have a retail location or customer service office, all work is done on line
