I'm sueing for defimation of character, deception and emotional distress. I live in Ca and the person i am sueing lives in NY. do i have to sue him in the state of NY or can i file in CA?

We were in a relationship. He cheated and sapposedly used me for all kinds of things. I have e-mails, recorded conversations, Im Messages, and a whole bunch of other evidence to prove my case. I just needed to know where to file..

My response:

Courts do not typically hear "lover's quarrels", usually dismissing them - - unless there was actual, caluculable, money damages. For example, he entered the relationship with you, asked you for money, and then left you.

In which State did your problems happen ? Then we can tell you where to file. However, if he's in another State now, where to file is going to be the least of your worries.

Additionally, if you made telephone conversation recordings from California, and if his permission is NOT on the tape, you can be held civilly and criminally liable. Remember Linda Tripp ?
