What is the name of your state?What is the name of your state?Florida
The Question I have is where do we turn for legal advice or to report a certain crime? What it is is a Stolen Student Loan. A father stole his daughters School loan by forcing her to endorce the check over to him. She wasn't allowed to see what she was signing but I assure you it was under duress. We later found out it was a Student loan, fraudulently applied for we think even by him. His daughter never saw a penny of the money or even the face of the check and tried to notify the lender of the problem but was just turned away because they could care who has the money apparently or they just didn't understand her plight. The loan is now in default. The daughter never had use or benefit of money meant for her, which she is responsible for technically on documentation. I recently wrote to the STATE ATTY General but haven't had time to get response. Her father by the way tried to write this off as a debt on his recent bankruptcy. He made it look like it was a personal loan from her to cover his Butt. That isn't the case and Federal loan money can't be discharged on a Bankruptcy anyway, especially if it isn't your loan but one you stole from someone else. Anyone got a clue where we can turn.. Let me know. Thanks. :(

**A: when did all this take place, is the daughter currently in school, what was the money used for, did the daughter benefit from any or all of the loan funds, what conditions amounted to the duress and why did the daughter not report this theft earlier. Who are you and what is your invovlement in all of this?

NO as you might expect the daughter, my daughter is not in school. Her education was pretty much derailed. No, she didn't see or benefit from one penny of the loan money. Her father most likely used it for his own bills or God knows what. She did report the theft within 24 hours but because she went alone and was nervous she was more or less laughed out of the police station and told she and her father needed to work it out and it was Most likely civil. When her father was contacted by the police for his version he lied through his teeth. Didn't admit guilt and made her out to be the problem. I assure you we have proof to the contrary. She filed a small claims suit but when he listed it on his bankruptcy papers as a personal loan to him from her no one questioned it and her case was put on hold. This is a clear case of Fraud and her father is responsible for the money to be paid back as he's the one who had it in his account and benefited from it. She has a copy of the cancelled check from the loan company and it went directly into his account. :(
