What is the name of your state? California

My mother and stepfather's second wife were co-owner's of a piece of property in southern California. My mom passed away in January and my brother and I have been unable to find out which legal form we need to file with the court regarding this property. To make matters a little more difficult my mother never changed her name on the deed as she also remarried. Whats even more ironic is the fact that not only are their last names the same but their first names as well. The only thing that separates the two is their middle initials

She didn't leave a last will and testament, right?

Official probate is needed because property is involved. Hire a probate attorney and get things started.
