What is the name of your state (only U.S. law)? Alabama
I am the defendant involved in a civil case (pro se). the trial has started, but i believe the evidence is on my side. What motion can I file with the court to have a possible judgement to my favor now, before the trial ends. Which is best: Judgement as a Matter of Law, Judgement on the Pleadings, Summary judgement pursuant to rule ?, or are all applicable? if i can not allways attend, must i file an affidavit of substantial hardship and what does it contain?
Also, the Plaintiff did not file a pretrial statement and I(Defendant) did. what can I do? can i demand his complaint be thrown out while requesting judgment on my counterclaim for this. what sanctions can i ask for?
