My wife lives in Arizona, ... I've been living in California for 1 year. I can't wait any longer for her to file (as she said she would). We were married in AZ, .. my question: can I file for divorce here in California even though she is in AZ ... and we were married in AZ? She is basically non-responsive in trying to help with this divorce, we do not have kids, we each took our own assets when we split up 1 year ago, and only have a small second mortgage we both signed for 4 years ago. She doesn't seek support .. only wants out the easiest and quickest way. I'm ready to do the deal now, ... but want to do it from California since I will be Petitioner. Which would be easier and quicker ... filing from AZ or CA? Responses from those who have been there - most appreciative!!
Thanks in advance!

My response:

Now that you have met the residency requirements of California, you can file your Petition for Dissolution in the County where you reside.

A judgment of marriage dissolution may not be entered unless one of the spouses has been a "resident" of California for six months AND of the county where the proceeding is filed for three months immediately preceding the filing of the petition. [Ca Fam § 2320]

IAAL

(P.S. Nice response to "Scared" - - she really needs to take stock of her life)
