who gets the baby?

My 18 year old niece was killed in a car accident, leaving behind a child 8 months old. She was not married . is it possible for the grandmother to get custody of the child ? or will it go automatically to the biological father?

This depends on whether the bio dad wants the child. Where is the baby today ?? If the biodad has not been around and has little interest then almost any relative can petition for custody.. and whoever has the baby today has a better chance at winning.
