Who gets to determine who is Media and what specification must be meet?

Is the Government allowed to decide on who considered News/Media?

Could CNN be deemed fake news by the president and lose their ability to get free FOIA request or other rights afforded to media?

Is there a department in the government who is in charge of being able to determine who is News or not?

Can an small school paper be considered media?
Can a KKK or black panthers news letter be considered media?
Could an internet blogger be considered media?

Can people on youtube who go to government buildings with Cameras and film the reaction of political and security considered media?
Could a government agency consider only print new paper to be media and discredit anything on the internet?

Is it like Taxi medallions cabs vs Lyft/Uber drivers?


Can they only consider media those who write positive information on than and consider those who are adverse to them as not being media?

Who (if anyone) in the government makes this determination and what are the requirement for the test? Are there exact specification that need to be meet and who is the arbiter of if they are good enough to be considered media?

That depends on the reason why being "media" or "press" matters. The White House, for example, limits which reporters may attend presidential news conferences and decides which media organizations are going to qualify for that. But then there is no right for anyone who wants to attend a news conference.

Could CNN be deemed fake news by the president and lose their ability to get free FOIA request or other rights afforded to media?
The criteria for a fee waiver for FOIA request is set by statutes and regulations. Media outlets do not automatically get a fee waiver. Rather, the fee waiver applies to anyone who can show that the request for the information is in the public interest rather than personal used.

Is there a department in the government who is in charge of being able to determine who is News or not?
There is no single agency that makes that determination.

Could an internet blogger be considered media?
Depending on the circumstances and what reason the determination being "media" matters potentially all of those might be media.

Could a government agency consider only print new paper to be media and discredit anything on the internet?
No.

Can they only consider media those who write positive information on than and consider those who are adverse to them as not being media?
No. The government cannot regulate based on the content of speech except in very narrow circumstances. That would violate the First Amendment.

Again, there is no law that sets out one specific agency for this or that defines what media is for all purposes.
