Who is responsible for making good on employee discount benefit?

Here is the scenario:

A furniture store offers a deep discount on mattresses for their employers. In order to receive a discounted mattress, the employee is to remit payment (in the form of a money order or cashier's check) directly to the bedding factory, and one will be shipped to the purchaser. Keep in mind that the furniture store also has these mattresses in stock.

The mattress was supposed to be in in 2 weeks. It has been 3. The employee is not confident that the mattress will ever arrive. Who ultimately is responsible for either returning the money invested or presenting the employee with a mattress? Obviously, the employee will first try to contact the factory, but does the furniture store have to accept responsibility in making this right at any point, as it is their benefit program?

nope! the employer is not responsible for the purchase. the employer ALLOWS you to contact the bedding company and make the purchase directly. wholesale?

the employee does NOT have to give you one of their mattresses to make you whole.

Contact the factory and inquire when your mattress will be completed and shipped. I suspect you're jumping the gun worrying about your money being refunded.

I disagree with Isis1 and agree with Beth3. (Although Isis1 is usually pretty good.)

The issue is, do you have a contract? While you have said you do, you have not given the specifics. I can totally agree with Isis1 if the facts lead me there, but *assume* you have something more.

Why do you think you have an employee "benefit" for the item?

I agree with Isis.


the employee benefit is the store has negotiated with the manufacturer to allow an employee to purchase a mattress at a discount. It is not that the store sell a mattress to the employee at a discount.

All dealings are between the factory and the employee and the store has nothing to do with it once they "introduce" the two.

OP paid money to the factory, that is who they seek a refund from.


did they guarantee you it would be at your house within 2 weeks or did they simply say it would be about 2 weeks?



manufacturing sometimes does not run just like one would want it to and an expected delivery time becomes just that; expected, not promised.

Thank you all. We don't even have an issue anymore, because as of this AM, we do have our mattress. Problem averted. ;)
