who is responsible for UPS-damaged item

What is the name of your state? Texas

It's now about 9 weeks ago since I received a broken guitar. I made several E-mails to the shipper and UPS, but most are unanswered.
It seem like a claim is pending (since weeks) but I do not get any answers or results.
UPS who smashed the package tells me that they do not deal with me but only with the shipper and the shipper does not respond to my E-mails.

I think UPS smashed my personal item (I paid for it, so it belongs to me) and is therefore responsible to compensate me and not the shipper.
Do I get something wrong here ?

Any help is appreciated.

was the packing damaged? a claim does need to be filed with UPS, if they wont let you do it contact the shipper and tell them to do so, however they should let you do it. They must come and inspect the packaging, so save everything. Call and ask to speak to a supervisor if you are getting the run around.

The package looked not to bad from the outside only a couple of holes and punctures.
UPS asked me to make pictures from the shippment and Email it to them and now they block me out. It seems like they followed the claim but they give me no furter information.

My problem is that the seller does not respond to me. Calls are not answered, I think he has caller ID and my number blocked. He does not answer any Emails. So it looks to me like he is collecting the money from UPS and wants to keep it too.

Anyway who could I litigate if everything fails. The shipper did his job and delivered as described. UPS broke it, who should I go after.

Even if UPS did damage the package, the seller need to be the one to contact them. They are the only person that actually KNOWS what condition the item was in when it was shipped.

Also, the contract for the insurance is between the shipper and UPS - the won't generally discuss it with anyone else.
