My neighbor & I, were both backing out of our driveway's, when when our vehicles hit, (he actually hit me) but when polie arrived, he told the officer that he was sitting in the street when I hit him , and that he never seen me coming. (in the street but never seen me!, yea right)
The police cited me for improper backing, because the damage was to the rear of my vehicle, and damage was to the diver side of his vehicle.
When I tried to explain that damage was to the left side of his vehicle, bt he was still in the process of backing out of his driveway, (Iwas stoped, I had put my vehicle in drive we the vehicles hit)when he turned into me, the officers responce was "well I could cite you for careless driving, at that point I thought better shut up. (cop with an attuide)
Then the very following day this guy contacts a ambulance chaser lawyer, and is going to sue me, my insurance Company has told me not to worry that they are investagating the accident, and that I have very adaquit coverage.
The investagator has said that I need to fight the citation because the damage to the vehicles clearly show that, if I hit him damage to my vahicle would be going from right to left, the damage clearly shows from left to right, indicating that he hit me.
Should I fight the citation (3 points), and should I seek additional legal repenstation since this jerk is sue happy?.
By the way is their any law that covers a counter suit for someone being a jerk?.......
