I live in Indiana, and have a 5 mo. old boy. I live with the father but we are not married. He is named on the birth certificate. If I was to move out who has the right to the child until it could be settled in court?

You both have the same rights to thte child by law until a court gives one of you physical custody. Meaning either of you could move out and take the child and then petitionthe court for custody. I would suggest that if you are planning on moving out, you keep the father notified of where you are moving to, unless there is domestic abuse that can be proven with police reports, hospital reports etc.. then you should go ahead and move and hire an attorney or petition the courts yourself to seek temp custody and support until there can be a full hearing by the court.
