I had some work done in my basement for water damage caused by the City that I live in. The company that did the mitigation and restoration understood that they would get paid when I got paid by the city. This company was reccomended by our Homeowners Insurance agent, the agent knew the owner of this company personally. The owner of this company and my Homeowners Insurance agent have proceeded in filing a claim for damages on MY Homeowners Insurance policy. Can they do that without any permission from myself or the other property owner??!!! Please help if you can.

Anyone can file a claim, and it's unlikely that your insurance company needs your consent to pay it. The contractor just wants to get paid, they're not doing anything wrong. When you get paid by the city, the money will then go to your insurance company instead of the contractor. If you are lucky, the contractor won't try to collect your deductible from you until after you get paid by the city. The government moves slowly and it's not reasonable to expect them to wait months and months to balance their books when there is insurance in place that can pay them. Depending on the size of the job, they may be out a lot of money for the materials they had to purchase, and that could be impacting their ability to take on new jobs.
