What is the name of your state (only U.S. law)? texas,in 1996 i recieve a settlement.i purchased a house for $76,000,my mother told me to put the house in her name.because i had just got married and incase the marriage didnt work my wife wouldnt get the house.so i did it,i just recently found out my mother refinanced my house without me knowing.what should i do?

At best, see an attorney. At worst, move on.

If you sue your mother (your only option for money), you will have to prove you had a resulting trust in the property and that she breached her fiduciary duties to you. You might be able to win, but there are things against you.

1. Staute of limitations and/or laches. Why did you take so long to sue?
2. Unclean hands. Why did you put your mom's name on it? I heard your reason, but is that a good reason? Or, was it more likely to cause your marriage to fail?
3. Hard law. Resulting trusts are certainly a valid legal theory. However, it is fancy law and you will need an attorney to review your facts to see if it would be cost effective to put on litigation over it.

**A: are you still married? When did you get married and when did you buy the property? Did you buy the property first and then deeded it to Mom? What did Mom say when you asked for the house back?
