i live in ca. me and my wife seperated a few years ago.she is from the philippines but has cousins in southern ca.she left with the kids while i was at work, checked into a battered womens shelter citing physical and emotional abuse of her and the children and drug abuse on my part(all untrue).at the time i was working and she was unemployed. the mediator said that they were giving her primary physical custody of the children so that she could obtain public assistance and get a place to live because otherwise she would have no choice but to move back to the philippines and not be able to be a part of the childrens lives.we have since reunited and had the court orders dropped.now she is threatening to leave again except the situation is reversed as i am unemployed and she is working with the exception that i have a physical disabiliy preventing me from working.i have relatives in the area but none willing to let me move in and i am still working on being granted ssi payments.if she is awarded custody i will be living on the streets.this would make visitation difficult if not impossible.my first question is how was giving her custody the first time in the best interests of the children and secondly would i be able to obtain custody of the children given the current situation on the same grounds that she recieved it on at first?please help i feel she may file soon and need to know what to do!!!!!!thank you.
