This is for Oregon law. This may sound like a stupid question, but I have been told for so long that I do not deserve part of my husband's pension, that I need to know why it is that I do? What does all of this mean and what help would it give me and what harm would it cause my husband? I kind of think I do deserve it. We have been together for 19 years, married for almost 17. My husband and I want our divorce to be as friendly as possible. We do not want to drag it through the court system. I believe that the only thing we will argue about is his pension. I am a work at home mom (self-employed). I will have no insurance, medical or dental, after we divorce. I am going to ask that he carry three years of insurance for me and I do not think he will have a big problem with that. At least I hope not. I am not interested in taking this man for everything that he has. I still care about him and I want him to have a life after me. He is the father of my child and I do believe that even though we cannot live together anymore, we will be much better friends than husband and wife. I would just like to know what does "taking his pension" really mean? What are the benefits and why do I deserve it if it is his pension? Hopefully, someone here can explain all of this to me. If I do not take a part of his pension, will I be sorry later? If it will be a huge fight about it then I will probably not pursue it. I would just like an explanation that we both could understand and then maybe he would not feel so bad about it. Thank you for your time.
