Why is it.....

Why is it that when the CP quits their job it is okay with the court and they will just let it go but when the NCP quits their job it is something horrible? Is it not the job of both parents to support the child. If I am the CP and I want to quit my job because my new spouse makes more than enough to support us is it not fair that the NCP should be able to do the same? (given that the NCP's new spouse is willing to provide the support)

I don't know of any Court that would care either way , as long as the Child Support gets paid , no matter who pays it , do you ?

I don't know how things work where you are, but a few years ago I was between jobs and I was doing some personal care on my own, I never stopped paying my support, I notified cs and informed them I would be self paying by money order. They took me to court, fortunately by the time I went I had a job, but even though I was self paying, the child support lawyer wanted me to do 14 days in jail, but since I made good faith effort and now had a paycheck they could take the money right out of nothing happened and the case was excused, I agree as long as the child is cared for it shouldn't matter and I believe that the custodial parent has some impact on cs taking it to court usually in a bid to make them look good and you look bad. Does anybody really know how it works?

Ahh yes but if CP quits their job and their new spouse makes 8 grand a month is it fair for NCP to have to pay CP child support? If CP quits their job because spouse makes so much is it fair that NCP has to cover for extra money for the CP's lack of a job?
 
I know that some states assign an income to non working parent but a lot of the assigned incomes are only assigned around the ballpark of minimum wage.

its not the stepparents' responsibilty to support their stepkids-no matter how much they make. thats the parents job.

Does it seem fair the the NCP that pays child support has to go out and work while the CP can just quit their job to be a stay at home whatever? It would seem to me that without them holding a job they themselves would not be supporting the child. Yet the NCP is supporting the child themselves.

I can tell you that after I was laid off, I was imputed my normal wage in reassessing CS. And I'm the CP.

Of course it's fair. If the chldren are being supported by the new spouse, and the new spouse is ok with that, what business is it of the NCP? The new life of the former spouse is no concern of the ex.

The NCP has an obligation to support the children. End of story. I would guess that the NCP is more than welcome to also quit a job and allow his/her new spouse to support everyone, if the new spouse is ok with that. As long as CS is being paid, the courts could care less.

In almost all cases a court would impute a wage to a cp in that scenario....which means that the cp would still be responsible for a specific level of child support. The courts don't care WHO provides the cp's share...just that it is provided....same with the ncp...if the ncp's child support is paid its never going back to court...
