(WI) Former landlord is bringing suit; claiming close to $4000 (assuming for damages, neglect, etc); In reality, greatly exagerating claims and throwing in alot of extras (like $300 for flowers mistakenly pulled from yard) in order to pay for remodelling of farmhouse. No default or outstanding money involved. Many counterclaims. Landlord has reputation as "scoundrel".

Small Claims appearance is Monday morning, 2/12/01,8:15 am. No funds for lawyer. trying to craft denial answer statement. Obviously, I need indepth consultation, advice, but would the following language suffice as specific enough, appropriate enough to meet requirements as denial of claim??

SMALL CLAIMS ANSWER
Defendant denies the allegations and charges brought by former landlords ____ in the above legal proceeding.

Defendant denies allegations and charges in said action based on plaintiff’s exaggerated, unreasonable and unproven/unprovable claims,
violations of Wisconsin and municipal laws, statutes, codes and/or regulations,
and landlords’ failure to fulfill their obligations in the lease. Defendant denies assertions and charges for alleged violations of agreements which were never made or stipulated between landlord and tenant.

(NB - key)
Defendant denies same based on landlords exagerating, inflating and inventing claims in order to retain and recoup funds to cover the cost of remodelling the property vacated by exiting tenant

Defendant petitions the court for a trial date.

In addition, defendant has counterclaims and requests requisite allowable time to prepare an amended statement and these counterclaims in conjunction with this case.

Thats a very good start......we will work on this over the weekend....

Do you have any pictures of the property when you vacated? to prove there were no damages, and none of the repairs were necesssary?

how long has it been since you vacated? if these "repairs" were done almost immediately after you vacated, you might have a problem proving they were not necessary..., but if he waited a month or two that would be better.

Has he tried to rerent the apartment? if so how long after you vacated?

Of course you will demand proof of all bills AND cancelled checks...BOTH front and back copies , he could show you a front of the check and it may not be stamped by the bank as paid thats usually on the back...or he could have just written them up and then ripped them up.

You want proof it was actually paid to the right person or company.
