WI-underage drinking

What is the name of your state?WI My son (18) just returned from court for a 2nd underage drinking ticket. He said the judge said this was his third offense, advised him his rights to an attorney and set a pre-trial date. This is actually his 2nd offense. the statute written is WI 125.07-4-b..if i'm reading it correctly, it refers to 3rd offense, and fines of 500 to 1000.00, community service, and possible suspension. My question is, based on attorney's fees is it feasible to hire one or should he take his lumps..i believe the fine is a little less for the 2nd offense..but we don't want to pay alot in attorney fees if the fees are up to 1000.00....he will ultimately be paying for this, but how do we get the 2nd and third offense issue straightened out?

You didn't happen to keep any of the old paperwork did you? Talk to the court, def get this straightened out. DUI is a big deal.

It's not a DUI, it's just underage possession or consumption.

Second offense Underage Alcohol carries a 90 day driver's license suspension. He won't be fined the maximum $1000... He may be offered to have the fine that appears on the citation cut anywhere from 25 to 50%. He'll probably have to take the suspension as well.

You could hire an attorney, but he might not be able to help much. There's really only two elements that have to be satisfied... Was he underage? Was he drinking or in possession of alcohol? If "yes' to both, he's toast.

To straighten out the 2nd vs 3rd issue, check his name in CCAP. You'll have to click the "Agree to Terms of Use" button, then search under his name. You may be surprised to find out it really is his third. If it's not there, check with DMV under his driving record. They list them as UAL.

If it were my kid, I'd make him take his medicine like a big boy. He wants to be treated like an adult, let him take responsibility like one.

Thanks...yes i did check the ccap and it doesn't even show the first one..only a speeding ticket and now this underage drinking ticket. We will make him pay for the ticket (oh yeah, forgot to mention he got sick and his friends panicked and called an ambulance for him to take him to the hospital..that's how he ended up with the ticket)..so he will be paying for those expenses as well. At this point, we've figured if he wants to hire an attorney, he will have to get one assigned by the courts cuz we're not going to do it He got himself into this, he'll have to get himself out! thanks!
