We live in the state of KY. My wife became employed, under one year ago, to a very large wireless company. I beleive she is being harrassed by her supervisor because she is pregnant. My wife found out she was pregnant shortly after started work at said company. At the time she did smoke. She was trying, as you would expect, to quit. Her supervisor at the time made some nasty remarks about her "killing her baby" and how she was a "bad person" for smoking. My wife immediately told the supervisor she felt like it was not her place to lecture her and it made her uncomfortable and that she was trying to quit. The harrassment did not stop. So my wife went above the Supervosr and informed the manager of the situation. The manager spoke to the supervisor and for a while the situation was quelled.
As you know, preganay requires 1 doctors visit per month for the first 6 months. Unfortunately because she hired in part way through the year she was only granted 2 sick days and 1 vacation day. Those were quickly gone for doctor visits. My wife missed a fourth time due to a pregnancy related illness and her supervisor began making comments to her and the co-wprkers about her abscense. The supervisor then attempted to write up my wife for her non excused abscense (despite having a Dr.'s note). Knowing her pregnancy law my wife went to her HR department and the wirte up was revoked and she was told she could miss any for pregnancy related illness provided she had a Doctor's excuse.
During this time another of her co-workers had missed more days than her, and had yet to provide a excuse OR had anything been said to her. Then, unfortunately my wife came down with the flu one weekend. While having the flu she developed a Urinary Tract Infection. A UTI is a leading cause of miscarriages. She missed a week of work, work that she would not have other wise miss had the doctor not told her to stay home because she was putting herself and the baby at risk.
Now her supervisor has given her a final warning for missing the week. Her company has deemed the flu and UTI not pregnancy related, thus not under the law. She was told if she missed another day she would be fired. She is only 5 months pregnant and has many more Dr.'s visits remaining. The other girl under her supervisor that is pregnant has missed more than my wife- and missed for the flu- but has not been warned, written up, or reprimanded.
2 issues here, one if an illness causes danger to pregnancy is it pregnancy related? Is it up to the employer, law, or doctor to decide what is and isn't pregnancy related. Secondly, can the company hold employees to different standards? One employee is being treated differently than another. It just seems unfair that already emotional wife fears work comes home crying everyday. The stress this is causing can have harmful effects on the baby. Is there anything we can do? Is this harrassment? Help us please.
