wife stopped by prof.from teaching

What type lawyer would I Need for my wife.

She has just graduated from a state university. with a B.A. in history
She is in the the teacher education program and has completed every requirement outlined by the state and
university to go out in the work place and student teach. Except for the head of the department has demanded that
she take a 3 hour written test on all American history during finals week to be placed in student teaching. She
refused stating that if you are going to require all student to take this test and indicate at the beginning of the
program that this is required then she will take it. The professor that is in charge of student placement
has admitted that this is not a requirement,but some thing that he does to a few students each semester.
My wife is 47 and has spent to much time and money to be stopped from working by this professor
how want to weed out someone that he doesn't like.He has directed the
professor in charge of placements to exclude her from student teaching
in the fall. She can't start her teaching career until he approves.What is the name of your state?

Your wife needs to DISCRETELY approach the dean of her school and also the university ombudsman about her concerns. It is possible the director is in a position to require this test.

I can tell you however that push come to shove your wife will be out oodles of time and money and the director will be out nothing (even if wife wins) and she will be alienated from the people she will need to get a placement.

Your wife should consider taking the test under protest. Talk with the ombudsman about this.

Not that I mean to imply there is a valid claim, but because she's over 40, you can try filing a complaint with the NYS Division of Human Rights: http://www.dhr.state.ny.us/faq.html

Only catch (other than lack of discrimination, of course), is whether DHR has jurisdiction over the schools, but that's for them to worry about, not you. Plus, it's cheaper than a lawyer! (It's free.)

I worked as a tutor at my university in writing and ESL. Two students who were set to graduate from the teaching program were assigned to work with me to correct issues as directed by professors from the teaching program. Unless the issues were adequately addressed, the students would not have been granted an education diploma. One student wrote at a fourth grade level (athlete), and the other spoke (and wrote) with an Ozark dialect from deep in the hills ("Y'al git a load of thishere problem"). It is possible to complete a college education and still have deficiencies.

Boy, can I relate to the last post.

Back when I was in college (yes, I rode to school on my dinosaur) I was the TA for a section of freshman writing. There were a couple of juniors in the class who had somehow missed taking this required course during their freshman year. Both were education majors.

Neither knew what a sentence was. Instead of a subject and verb, along with the associated objects, prepositions, articles etc., there would be a meaningless string of words that made no coherent sense. All I could think was, in only three semesters we're going to send these two out to teach elementary school? (My husband is one of the last holdouts - his students do not pass his course unless their papers are in correct grammatical form.)

I have been given a few good idea's which we have focused on
in addition to writing to the dean and placement prof.

My wife could take this test and probably do will on it,but he has no right to subject her to
this because he wasn't impressed my her in his mock interview that he puts students though.
She already graduated with the her degree in history. She has a 3.25 gps she has completed all
here teaching and methods classes. She has taken and Pasted the state Language,arts and science
test. She has completed 100 hours of student observation.
My wife completed everything required of her in writing before she started the teaching program.
and no where in the university web site ,education or history department web site or department
of professional development web site does it state that this is a requirement. This is something this
professor just does to certain individuals for what ever reason. This is not right and my wife doesn't
want to give in.
