I had a convict of misdemeanor (charge of shoplifting) 4 years ago and had had it "expunged" after I successfully completed all terms of the probation, pursuant to Section 1203.4 of the Penal Code. However, I still have following concerns:

(1) Since I'm applying for immigration now, I would like to know if INS check criminal record for green card applicants? Can INS find this criminal record even though it has been expunged?

(2) Will this record exist forever or be purged after several years? I heard that if the record is a misdemeanor the DOJ will purge it after
10 years, is it true?

Thanks in advance and I look forward to hearing from you soon.
