My son has benn living with his father for two years ( he is three years old.) I ran into financial problems (homeless) and his dad lives with his mom so I knew he would be more stable there. Well know I am back on my feet better than ever. I have a great job ( work for the city) and have my own apartment, car, etc. and am single. My baby's father has deneied me my rights with my child from day one and I have been fighting from day one. There is nothing legal with the courts. Matter of fact he is not even LEGALLY the father. Well, i am sick of the games and no lawyer willing to help me with out thousands of dollars to pay them. My x is a drug addict, does not work but still puts my son in daycare, and is facing charges of assault in the third degrre for hittin an eight year old kid in the leg with a dart gun. I know I will not get in trouble for just taking him but will this do more harm than good. I believe he is in a dangerous situation and I can provide him the attention and love he is missing. Please help!

If no one has legal custody of the child then you can within your rights pick that child up and keep him until you go to court. From what you have said I think that you should because that child is obviously not in the best of environment. This is just a suggestion, and you have to carefully plan this. Pick the child up and then file for temp. custody. Get everything together that will help you with your case..and go from there. But first and foremost, remove that child from the Fathers care. Then get a good attorney...Good luck!
