Will I get in trouble for the name I've chosen for my online gaming community?

Hello, I am starting a gaming community called F1 Gaming. The F1 stands for Frame 1. Our community will host servers for different games online for players to join and be a part of our community. We will host servers for all types of games eventually but we'll use Minecraft as an example as one of the games we'll host servers for. Through our servers we plan to have cosmetics and monetary items that can be purchased through our webstore. We own a domain name for the name of our community. My question is, will we get in trouble for this name? Should we rebrand to avoid copyright issues with big companies like Formula 1 since they are known as F1.

I'm not entirely sure how this all works so wanted to get some advice,

You'd want to consult a trademark lawyer in the country or countries you plan to use the F1 name. Formula 1 does have a registered trademark for F1 for a variety of goods and services connected with Formula 1 and that might indeed cause you trouble. For example, if you sell clothes with F1 on them that might infringe the F1 trademark. You need to run your exact plans by the attorney to see what risks you take. Or, since it seems you are still early in the concept stage here and you don't see too stuck on the idea of using F1 you might instead just pick some totally different (and very unique) name that no one else uses so you are guaranteed not to have a problem.

You are best off having a trademark attorney in your area review your gaming community plans before moving ahead with the F1 name.

Offhand, and having done no research at all, I see no problem with your name, based strictly on the information you have provided. There appears to be no conflict between, or consumer confusion that would be generated by, Formula 1 and your Frame 1. Many companies share the same acronyms and abbreviations.

Whenever you know in advance that a well-established company with a large legal team has a registered trademark, it is smartest to avoid use of the same trademark.

Trademark law centers on consumer confusion but large companies are apt to react to any use of their marks with cease and desist letters and threats to sue for infringement, whether their claims of infringement have any legal merit or not.

Because you can avoid irking Formula 1 and avoid the costs of defending against a potential lawsuit by choosing a different name that is unique to you alone, that probably would be best. You don’t want to invest your money in a name and in marketing only to have to it all taken away from you.

This is your opportunity to Create Your own Brand I have no idea why you would clearly use an existing mark . This seems like nothing but trouble and I'm not sure why you couldn't just make up something a little [or a lot] more unique.

“Frame 1,” as a note, can also be problematic.

Starting with a unique name can require additional marketing to familiarize the public with the name in connection with the specific goods/services being offered but some of the most successful companies have done just that, distinguishing themselves from all other companies through the use of invented-word identifiers (like Nike and Google) or portmanteau words.

No new company should want to blend in with the crowd or be mistaken for something its not.

When you discover that the same or similar name is used by many different companies but you decide you also want to use that name, one of two things generally happens. One, your new company is never able to build a good consumer base because your company name/trademark gets lost amongst the crowd - or two, your new company increases its risk of infringing on the trademark rights of one of the many other companies with the same name.

So, yes. Picking a name unique to you and your gaming community is best, legally safest and almost always the recommended path to take.
