and by 'next year' I guess I technically mean this years, which will be filed at the beginning of 2006.

I just filed Chapter 7 bankruptcy last week. I have yet to get notice of my creditors meeting, but I was wondering what the chances that the trustee will lay a claim on my upcoming income tax return, are.

If you have enough of your exemptions left over, you may be able to exempt at least part of the refund. Take the amount you got this year, and pro-rate it, like 8/12's of the amount, and if you can add that amount to your exemptions, you may be able to keep that much.
