I own a mobile home (that has additions built onto each side) on a rented lot in a park.

I am 4 months behind on my rent due to my husband's recent disability/ other problems.

About a month and a half ago I applied to Salvation Army for assistance with my rent. And was supposed to have recieved help 4 weeks ago, but because of the 2 hurricanes my application (with several others) has been postponed.

My husband has applied for disability, and we plan to catch up the rent when it starts.

The park manager/owner is aware of all of the above and has been very patient with me. However, because Hurricane Charley destroyed the park office, and the park needs a replacement, I am afaid that they will evict me in order to get my mobile for an office. (No, I cannot afford to move my mobile out of park).

My question is: What would my park need to do in order to evict me?
Will I be able to file an objection to eviction?
Can they put a lien on my mobile?
Approx. how long would eviction take, from 1st notice to actual eviction?

My husband and I are scared, so any info will be greatly appreciated.

Thank you for the reply. We have tried all the churches, unfortunately (but I guess understandably) they are more willing to help families with small children than older people without small kids, then to complicate matters they are also helping hurricane victims. I guess you could say that we fall thru the cracks, and that is why it looks like we will be evicted.

I am hoping that someone has knowledge of this type of eviction and can help me at least delay the inevitable for a little while.

But, I do appreciate your reply anyway.

Have you tried you area trustees office? Also contact your welfare dept. In Indiana there is a program called 'Area 4' that also helps with utilities and what not, not sure if you have something in FL like that but it's worth asking about. Most places will only help for a month and I know that doesn't help much but something is better then nothing.

Thanks for the reply tigger. We don't have anything here like you describe, we have gone to all possible sources of help. But according to what the different agencies have said, we have several things working against us:
1. We don't have small children.
2. So we have shown them the court order for my husband to pay CS arrears, but they won't consider that because all his kids are adults.
3. There are so many families that need help right now.
4. Alot of agencies are almost out of funds, and won't recieve more from the govt. until Nov. 1.

Well, as they say, it's hell to get old. (actually we are in our early 50's, but..)

Who knows, maybe Ivan will hit our area and I might not have to worry about eviction after all. My husband and I can always pack our clothes and our little dog and head off into the sunset seeking our fortunes, LOL. Aww, don't pay attention to my rambling, I'm only trying to keep a positive attitude.

We've been there. You could look on the bright side. Have you looked into income controlled apartments for disabled or elderly(I don't consider you to be elderly but my MIL isn't either and lives in one due to disability). The other up side is although SSDI can take what seems like forever to get you get at least one back pay check to help you get caught up and get all the things you lost or missed out on when you didn' thave the income coming in.

This part might not help the OP, but may help someone later who reads this post.

Just a clarificationof Tigger's post: The program is called "Area Agencies for the Aging". You (tigger) just happen to live in Area 4 of the program. There are 16 different areas.

The program is run by the state Family and Social Services Administration. More information for Indiana can be found at: http://www.in.gov/fssa/elderly/aaa/

For the original poster, they could try the Florida equivalent, which would be at http://elderaffairs.state.fl.us/

Thanks so much for the info, I'm going to check them out tonite. I'm also going to check on disabled housing, I had checked on it for myself 7 yrs ago, but then met my husband. I had forgotten about that possibility, thanks for reminding me.

She can apply for housing, and prepared to wait and with owing a past landlord money (at least 4 months arreages) that does not look good.

Why did you not look into this before falling 4 months delinquent????

I don't know what part of Fl you live I thought it was Central, here is a link to Center for Independent Living centers they will have disability resources including help with getting your husband on SSDI and legal or housing issues.

Also eviction takes time so you might want to look up those laws in your state they mey be required to give 30 or 60 days notice and it may be different for trailers. There may be some special accomodations for disabilities and also check with FEMA

I just do not see how the latest provided links apply to this case.

As to the other links: possibly legal aide provided thru Florida's association of Area Agency on Aging-if the poster meets their requirements.

My question is: Are you renting the trailer as well as the lot? Have you been served an eviction notice in accordance with Florida LL/Tenant law?

p.s. The owner may evict you not to gain your home as an office but due to your failure to make rental payments.

No, I have not been served yet, but I can see the writing on the wall.
