Here is my question. We live in Texas. My husband 3yr old little girl lives in Nevada.(whom he has never seen but wants to be a father to, is paying his $550 child support and paying back the state because mother was/is on welfare)We are wanting to know when he does get visitation he will have to start out with meetings so that his little girl can get to know him. WILL WE BE RESPONSIBLE FOR THE EXPENSE TO TRAVEL TO NEVADA AND CAN THAT AMOUNT BE DEDUCTED FROM HIS CHILD SUPPORT PAYMENTS?

Unless it is otherwise ordered. He will be responsible for the cost of visitation and no, it will not be deducted from CS. This should have been addressed at the visitation hearing.

You might want to ask for the cost of transportation to be shared, once the child is traveling to you. Until then, he will have to pay for his costs to go see her.

If the visitation is going to be extended visitation (say, a month during the summer or something like that) you can ask for the support to be abate during the visitation period. Some states allow for that already. For example, PA allows for 50% abatement of support during periods of extended visitation.

In our situation travel expenses are being deducted from child support because the child lives in MN we live in AZ. And more than likely the court will find it in the best intrest of the child to have a relationship with the non-custodial parent. Get a free consultaion with an attorney about, they will let you know about the laws in your state and let you know how to go about it. Good luck!!
