For the state of Vermont
If you do not mention a son one way or another in your will
is this still a legal will and can the court add this person?
they is no new will and i will not be the one contesting it ,it would be the mother of the child , she stated everything belongs to the child no matter what the will states.and as far as the estate goes it is not worth much .It is the principle of it my brother wanted his wishes carry out the way the will was written,and it did not include this child. He will collect social security!

Children are supposed to be mentioned, and there are special Vermont state provisions for this. You need to consult with a Vermont probate attorney.

No one can be added on, but you can give a portion of your share of the estate to the person, if you wish.

What is the value of the estate? Have you examined the new will to find out if there is a penalty to any heir who contests it? You must figure out whether it would be worth it (would you gain a large share of the estate or how much would it be) if you are successful in contesting?

Last will

the estate is not of much value it is the principal
of his Last wishes, he never saw this child and the mother
would not bring the child to meet the father even when she
knew he had choose to give up.
He did not want anyone to call her or let her know anything.She lived with him off and on for two years.
