Winning Internet Auction Bidder Not Responding To Invoice

Question. I operate a small business in which I accept items on consignment from the general public then offer these items for auction on eBay for them. If a registered eBay bidder is deemed a winner of one of my auction listings then said bidder has entered into a legally binging contract as stated by eBay notification to winner. I send winner an email invoice for payment describing that I would like payment made through PayPal(merchant account accepting Credit cards) or by sending me a check (Business or Personal) or MO within 5 calendar days after receiving the email invoice.

If winning bidder responds to email invoice then one of two things happen. If they paid through PayPal I get a notice of payment. If they respond by stating payment will be made by check or MO I again receive a notification.

I treat this action ( notification to me that payment will be made by check or MO) as accepting the purchase contract. I treat the winning of the auction as a Purchase Contract.

What legal action can I take if winning bidder delays payment of notification past the stated 5 calendar days and even after another 5 calandars days if I was to send them a 2nd invoice? The property is still in my possession waiting to be shipped and the consignor is waiting for their proceeds from the auction. If there is a Dollar ceiling requirement. The amount is $400.00.

Ebay policy lets me submit a "Non Payment" to the bidder record. That still allows the person to get away it. There must be some means we small business operators can hold these "Non Payers" accountable. Seems, to me, they are commiting some fraud here. [email protected]

If your complaining over a non-paying bidder then Ebay is not for you because there will be plenty more. File the non-paying bid and get your listing and final fees back and leave it at that. If the bidder keeps repeating his actions then he will be suspended.

No sense in leaping off a bridge because of a person that doesn't follow through on Ebay. :rolleyes:

Welcome to the reality of Ebay.

Now, if he doesn't pay asap go to your next bidder and see if he will buy for his last bid or something between that and the high bid.

I have been offered several "Second Chance Offers" - - e-mail the next to highest bidder and ask them of they want the item for either the highest bid that they put in- or for a few bucks shy of what the highest bid was for - if there is not a huge difference.
If the high bidder won for $400 and the 2nd place person max bid was $380 - see if they will take it for $380-$390 - they might., You can find that info in your bidders tranasction history. It's neat to look at what people high bids are for some stuff!!
