Wireless carrier employee unauthorized access of account

What is the name of your state (only U.S. law)? I Live in Texas

at a wireless major carrier store, one of the employee's car was hit by somebody in the parking lot.. i was called in and my wife to go and answer questions, because they thought we were involved, which we were not.. we answer questions and they let us go . the next day there was a police car at my house, no call ahead or nothing he just showed up.. bottom line wireless store employee accessed the account to provided police with my address and started calling all the 3 lines that we have we them. trying to investigate on her own .. the car hit case was dismissed at a later date .. i contacted corporate office of wireless carrier to let them know what she did and they completed an investigation and confirmed that she had accessed my account to get information with no authorization. the corporate office from the wireless carrier is offering me up to 1200 to settle for the incident, however i feel i deserved more compensation .. i feel unsecured, because the employee has my address and who knows what else, i am afraid that if she is going to looses her job , that could bring me further problems or even harm to me or my spouse. i am actually thinking of moving. all of that process would cause me financial hardship.
i would like to know if what they are offering me is fair, and if i should hire a lawyer, what type of lawyer and what should i expect. i would like to thank you for your response, your time is appreciated .

Take the money and run. Your address is public record and can be found by most people using simple free internet searches. On top of that, when you bought and activated your phones, didn't you provide your address to...

A cellphone store employee?

If you write checks, isn't it printed on every single check?

I think you are missing the point. This employee went into my account b/c she though I hit her car. She sent the cops on me, which later it was proven I have nothing to do with the hit and run. Believe or not, ppl feel or react differently to different situations. As far as I know the police can't get that information from my wireless provider or get any information unless they have a subpoena. The fact that the employee went into my account, provided to the cops, with out my concept.... I think is not right.

You're being offered $1200 as a "pita payment". Take it and run. Really.

Ok, turn down the offer, get out your check book and hire a lawyer (at roughly a couple hundred dollars per hour (which is not recoverable)) and file some sort of invasion of privacy suit (which is a non starter since your privacy really isn't protected in most circumstances) or any other sort of suit you believe may be viable. Spend the next couple years of your life attending depositions and hearings (and each one is charged to you by your attorney), hope it gets into court where you can set before a jury and tell them;

She looked up my phone number using [phone service provider]'s equipment and I believe I have been wronged.


Of course you have to have a recognized tort to get this far. So far i don't see one but as long as you pay your lawyer, they will keep looking for one that might apply. Then you need to show damages. Those would be...hmmm...um...well...ah...ummm...I thought about moving because I thought the employee might be some lunatic that would use my address, which they already had since I walked into their store and wrote s check (with my name and address on it) when I contracted for phone service, and come and do...umm...ahhh...ummm...well, something bad.

The defense: well, did you move?

You; no but i thought about it


Defense; did the employee come to your house and cause you harm?

You; well, no


Defense; did the employee ever contact you after the initial incident?

You; well...umm...no...but they could have

So, your honor, I really don't know what to say here. Plaintiff has stated no valid cause of action, no damages...in fact, I don't even know why we are here. Given that this is obviously a frivolous suit, I request the court order the plaintiff be ordered to pay the defendants legal costs.

Judge; you got it.


Well, it's been fun but the notre dame pre-game show is on and I have better things to do than listen to some whiner complain about a non issue.

The only way that you could hope to collect any more from them, is if the employee's actions actually COST you more than 1200.00. In other words, if you had actually been arrested for hit and run, had hired an attorney to fight the case, and were found innocent at trial, and your attorney fees and lost wages were more than 1200.00. It doesn't sound like that is the case for you.
