withdraw temporary custoday? I have child in my home?

What is the name of your state? NY
In June We obtained temporary custody of my 4 year old niece directly from my brother in law, she was NOT placed in foster care at the time. Several weeks have gone by and this child has become very violent has no reguard for authority, screams and screams one minute then starts singing a song? Has been hitting my own children, time out is a joke and she sits and laughs at us. We have decided to withdraw our petition for custody, the CPS worker just can't seem to help me, wants us to go get the child to talk to someone, I know this will take years of therapy and we just can't do it, We have to think of our own children. I called family court and they said just fill out the form and thats it, I asked what do I do with the little girl? they don't know???
My mother in law is in the process of having a interstate compact done for this girls baby brother who has been in foster care since he was born(4 months ago) I was told by the CPS worker that If I withdraw the petition for the girl, that the infant boy will be up for custody for anyone that wants him and my mother will not get custody once the interstate compact is done? Can anyone help me, or at least tell me if this can happen?

I guess what I don't understand is why you aren't willing to get this child the counseling that not only you know she needs but also has been suggested by CPS. You haven't gone into the details of what has happened in this child's life but I am assuming it was pretty bad if the state took custody of the baby at birth that the home was unfit to be in and some pretty drastic things went on there. I understand your concern for your own children but tossing this child out isn't going to help her either. You have said you know that therapy will take years to control this. Who has told you this? Have you had her evaluated in any way?

As far as your mother getting custody of the other child and that not going through if you fail to petition for custody of this child I can't say for sure. You're best bet would be to speak to your attorney that is helping you with this custody issue now.
