My cousin's pay is being held by her supervisor. She was supposed to get paid on the 5th of the month but she didn't get a written note from the company until yesterday. The claim is that her immediate supervisor has placed a hold on her check b/c she didn't want her to be overpaid. Is it legal to withhold her pay without sufficient notice? My cousin faces detrimental financial situations and plus she's pregnant. She feels harrassed every day by her supervisor and doesn't know what to do or who to call. Any advice would be appreciated. -Thanks

The employer has no right to withhold that paycheck. Even if the employer has overpaid the employee, the employer has to correct that mistake the next pay period. I would advise your cousin to notify your state's department of labor about this matter.
