A couple questions -

Can a landlord hold back part of a rental deposit for 'cleaning supplies'? The landlord sent a itemized list that included, believe it or not, "Windex". The apartment was thoroughly cleaned, and there are pictures to prove this. The landlord didnt claim the carpet needed cleaning or anything major, just a laundry list of cleaning supplies.

The issue here is the landlord sent notice to raise the rent (on a month to month lease) and the renter said no, we'll be out in 30 days. The landlord got mad and petty. The total amount held back is less than $200.00, but there is more than just principle and money involved here. The landlord was a royal pain in the arse for the nearly three years the renters lived there. So,the questions are 1)can the landlord hold back part of the deposit for 'cleaning supplies' that with effort could not have been used up in cleaning what was already clean and 2)if the renters file in small claims court, can they file for more than the actual monies withheld?

If anyone has a link to the appropriate statues, that would also be appreciated.

If a tenant disagrees with what a LL has with held from deposit funds the only recourse they have is to use small claims court and bring with them the proof they have that can show the court and allow a court to decide if the LL has acted unfairly .
