I am in Illinois. My question is...a driver hit our car while it was park in front of our house in the early morning hours. A nieghbor woke us up to let us know that our car had been hit by a car. The car that hit us was not drivable so they left the car at the corner. Insurance card laying on front seat. Later that same day the owner reported the car stolen. Which it was obvously not (no forced entry into the car) no steerring column broken. A theft alarm the car had was NOT going off. How can I get a resolution from thier insurance company. I am disabled and need my car for doctor appointmennts and other things to take care of. I need helpWhat is the name of your state (only U.S. law)?

They need to complete the theft investigation before they can make a decision about your damages. That can take time - sometimes a long time. If you have collision coverage on your vehicle, you can use that and let your insurance company worry about getting the money back from the other insurance.

You don't say that they have denied the claim. I good adjuster will see right through this claim of theft for the reasons that you mentioned. Their insured should be able to explain why a theft report was not made prior to the accident and how this other person got the vehicle keys. If this person got the keys, the owner should know who this person is. There are so many things that the adjuster can ask that the owner probably won't be able to account for if the vehicle was not really stolen.
