indiana- hello In 2002 my husband and I purchased a home in the basement there is a sumppump so we asked the guy we was purchasing it from if it had ever had any problems with water he said no.so we purchased it.as soon as we closed we went to get the insurance.we told the agent about the pump and we told him that anything to do with water we wanted covered that we didnt want to come home and find water turds or anything floating in our basement that we wanted 100% replacement cost.in 2003 we had a lot of rain and they turned us down didnt even let us file a claim.so we hired a lawyer.last year they made us a offer thru the lawyer we waited about two months no check.so we called the lawyer.he called them they with drew there offer.this has caused us to have to file bankruspy.the lawyer then calls and say he has just filed it in court the day befor the statue of limits is up is this normal.also I find out last week the guy we purchased the home from lied

What is your legal question? All you asked was is this normal. Is WHAT normal? What type of coverage did you buy? Do you have sewer back up? You said that rains caused the damage. Was it a flood, or just heavy rains?

Do didn't even say what the claim was for, only that it rained.


Periods, commas, spaces between words, sentences, and paragraphs are your friend. Mine, too, acutally. How do you expect people to understand what you write, when you do not even know/understand/comprehend the English language?

Regular insurance does NOT cover water damage from natural flooding (unless possibly a result of something that is covered). Did you read your policy completely?

If flood protection is desired or required, that is a separate policy. See the National Flood Insurance Program http://www.floodsmart.gov/floodsmart/pages/index.jsp

Why didn't the pump get rid of the water. If the sump pump was essential, it would have been wise to have a secondary battery powered pump in case of power failure. Unless you are in a flood plain, it can help to make sure land slopes away from the home and that gutters are clear with long enough extensions to direct water far enough away.

Hello I did use periods at the end of my questions.My question was can they with draw there offer when it was accepted.And what is the proper time to file a case.Is it standard to file the day befor the statute is up ?or should it had been filed after the lawyer took the case.Thanks

As efflandt suggested, it would have been wise to have a back up battery pump. Also, some ins. cos. for an additional cost will issue optional sump pump failure coverage which is always a good idea to purchase.
You are saying offer was accepted but usually an offer is officially accepted when you accept & cash the check and/or agree in writing to the settlement.
