My fiance cancelled a shipment she had ordered online after numerous delays and a failure to deliver. The company agreed to cancel the order and I have a printed copy of the "Order Status", which confirms the cancellation on 3/28/07. On this evening of 3/31/07, we received a phone message from the actual manufacturer stating that the package had shipped out on Friday 3/30/07 and would be delivered to her WORK ADDRESS at 10am on Monday 4/2/07. The man gave a Fed-Ex tracking number that was not valid and no phone number where he could be reached. We called the online company and the manufacturer but they are closed until Monday. If this package is delivered to the hospital that employs her, she can be seriously reprimanded or even fired. Our legal concern is that she NEVER gave any of these companies her work address and the address is not attached to her bank or credit cards. Additionally, the package should not have even been shipped since the order was cancelled. Since her personal information was obtained without her consent, can she seek legal action against the company(ies), should she be demoted or fired? Thank you. What is the name of your state?

What make you think your fiance's work address is personal information? Address's are public information and available to anyone, ever look in a phone book?

Was this call a recorded message, a computer generated message or a real person?

The man gave a Fed-Ex tracking number that was not valid and no phone number where he could be reached.
Could your wife be the victim of a prank by someone who knew about the trouble she was experiencing with this product being delivered and then her canceling of the order?

When you say you received a call from the actual manufacturer of this product, I assume your wife ordered the product from a dealer or someone who sells the product as an agent or distributer for the actual manufacturer. If this is the case, it's unusual for the manufacturer to contact you directly and on a Saturday evening at that. Add to that the fact that you were provided with a FedEx tracking number that was not valid and were told this package was going to be delivered to your wife's place of employment, which you claim she never provided the on line company, I'd have to conclude that someone is pulling her leg.

Was this product supposed to have shipped to you, directly from the manufacturer originally?
Was it supposed to ship out by FedEx?
How long has it been since the original order was placed on line?
Was the product payed for at the time the order was placed and if so how? Credit card, PayPal?

generally speaking,

A company would never change the address given, that makes no sense, it actually makes bad sense.

A company would never look up your "work address" that makes no sense, unless they were possibly verfiying you were you and ruling out fraud.

A company would always prefer to ship to the billing address of the credit card anyway.

A company would not "phone you" to let you know they are shipping something. They would send you the information via e-mail, or not at all.

So... it's 4/4, did the package show up?
