I was a IAM Union member working for Northwest Airline. I was Under Contract when I got hurt on the job while working. The company sent me to one of their Dr's who said the reason I got hurt was for being fat. With that I was let go for not being able to perform my job.

Under my contract a injured worker was to be accommodated within his work position at no loss of pay or seniority. Because NWA claimed it was a fat issue I was not given this.

I found another job that fit my restrictions but I lost my seniority and took almost a $1000 paycut.

I got a work comp lawyer and we took it to court over the fat issue and won. I got some payments to cover the gap from my old job to my new job. But still had zero seniority and was in a different building and dept then prior to my injury.

Shortly after winning my case I was let go due to the merger with Delta.
On Unemployment I dont get disability.

According to my contract if a worker gets hurt they are accommodated in their department at no loss of seniority. HAD this happened I would still be working there at full pay.

So while the work comp issues were handled can I still go back and go after them for contract violation?

My union had better things to do then fight for someone let go for being fat.
