One of my relative's husband had died from heart attack caused by excess exposure to lead-acid at his factory. Worksafe inspectors had known that the factory had an unsafe working environment which did not comply with the government standards. The problem is that the 2 children have now been diagnosed with lead poisoning (direct contact with their father). Can an action be brought against Worksafe inspectors to recover damages for the personal injury suffered by the chilren based on the negligence of the inspectors to issue an improvement notice? And can economic loss arising out of health care costs be recovered? thxthx!
