I am a South Carolina state employee and injured back on job. Required surgery (lower disk rupture) and was out of work for 6 weeks. I have been retuned to by my doctor. Still have left leg pain and weakness. I was told workers comp will try to settle with me. I want to know how they calculate this settlement and how much it will be. What happens if same injury recurs?

Thank you for any help.

Do not settle until you first talk to a personal injury attorney. Once you settle and take a lump sum, that is it. If the same injury surfaces in the future or other problems manifest self due to the original injuries, then you have no recourse against the parties. Be sure to keep seeing a doctor for your left leg pain and any other injuries you currently have.

I was looking along the same lines as your case before for some good solid online legal advice and I came to a site called mycounsel.com, and they have a very comprehensive yet logical and easy to follow page on worker's comp... here's the URL
http://www.mycounsel.com/content/workerscomp/overview.html

it explained everything to me without typical legalese etc... good luck!
