I have had a workers comp claim for 4 1/2 years and been recieving benefits off and on for most of that time. I am considering signing off and wonder if my medical will still be covered and how do they figure out how much to offer.

I am a law school graduate. What I offer is mere information, not to be construed as forming an attorney client relationship.

I am not sure how the formula works: but here is a few places you should call and ask before seeking legal counsel to get the process done:

1) Read workers comp under attorneypages.com
2) Contact EEOC (and without giving your name, ask for information on this type of worker comp activity).
3) Your employer should have given you some sort of pamphlet with contact numbers. Call them.
4) Also, last thing, try your state bar and ask if they have any consumer brochures on workers comp (info you need to know type thing) and/or point to a free organization that can give you answers.

Hope this helps. It is early in the morning for me.
