I AM AN EXAMINER WITH THE STATE OFCALIFORNIA AND HAVE BEEN INVOLVED IN NUMEROUS ACCIDENTS SINCE I AM TAKING DRIVERS OUT THAT THE MAJORITY HAVE HAD NOT ENOUGH PRACTICE. MY FIRST ACCIDENT HAPPENED IN 1987 AND I WAS OFF WORK FOR ALMOST FOUR MONTHS. THE PERSON WHO WAS DRIVING HAD NO INSURANCE AND WENT BACK TO CHINA.IT WAS DETERMINED THAT I HAD 15% DISABLED. FIRST QUESTION IS IF THAT WAS TRUE SHOULD I NOT BE GETTING A MONTHLY DISABILITY CHECK. THE STATE FUND THAT COVERS US ARE WORKING ON CASES FROM 1999 AND I HAVE NOT GOTTEN MY HOURS OF VACATION AND SICK TIME REIMBURSED BECAUSE THEY ARE THAT FAR BEHIND. I HAVE BEEN NICE BUT FOR THE LAST YEAR MY PAYCHECK HAS BEEN DOCKED FOR TIME OFF BECAUSE OF SEVERE PAIN AND THE PAIN MEDICATION AFFECTS MY DRIVING SKILLS. AS AN EXAMINER WE HAD TO SIGN A PAPER THAT SAYS IN ECCENSE THAT IF WE ARE ON MEDICATION PRESCRIBED OR NOT PRESCRIBED WE CAN LOSE OUR JOB. FOR THE LAST FOUR YEARS I HAVE NOT BEEN ABLE TO GO ON A VACATION BECAUSE OF NO VACATION TIME ON THE BOOKS. ENOUGH IS ENOUGH I NEED HELP. I HAVE MISSED SO MANY FAMILY FUCTIONS SUCH AS GRANDKIDS BIRTHDAY, MY SON'S COLLEGE GRADUATION ETC BECAUSE I WAS IN SO MUCH PAIN THAT I COULDN'T GO. I NEED A GOOD WORKMAN COMP LAWYER THAT WILL REALLY FIGHT FOR ME AND NOT BE AFRAID BECAUSE IT IS THE STATE OF CA.

4yrs on the job and no vaction time?? what are you not telling us if you were on a job with the same company for 4yrs you should have acured vaction time

The last four years my scheduled vacation has been cancalled because I had to use my sick time and vacation to see the doctor or go to therapy or not able to walk and sit, so unable to work for a day or two. To be able to get some relief I have to take medication that I can not work with even tho it is prescribed. We had to sign a paper saying if we take prescribed medication that alters us which it does we can lose our job.
We schedule our vacation the first week in Dec and that is the only time you can take off. So for instance last year I had the week after thanksgiving scheduled off and when it came time I only had 11 hours cause I had to use my sick time and vacation time for doctor app and off sick. I was scheduled for four weeks vacation during the past year and one week I got one day, another vacation I got 2 days. Every month for the past year I have been on dock not being paid for the time off because workman comp has not given back my hours since 1999. Last year I was in five auto accidents doing my job. There are 12 examiners in my office and 11 have been in multiply accidents the 12th one is a new hire, who replaced an examiner that was hurt after three months doing this job and has had two or three surgeries. I have been doing this job for almost 18 years with multiply accidents.

I'm not sure about this but if workman's comp doc's gave you a %15 disabilty did they close the case? were you awarded a cash award? did you reach mmi? they give you an imparement rating? these are questions you need to know and ask your workman's comp case manager....
