My husband was injury on the job almost 2 years ago. He had surgery on his back and was given 35% disabilty. A week after the surgery we were contacted by his employer and asked to return his uniforms, they said that they were changing to a different uniform supplier. When we asked for a replacement set we were told by the receptionist, confirmed by the owners wife (also the bookkeeper/office manager) that he did not have a job to return to. He was a sheet metal mechanic and all his skills were in labor fields. He was released back to work (sedentary duty) more than six months ago. We have a lawyer but so far he has not answered this question to us: If he can return to work (sedentary duty) but has been terminated/let go whatever you would like to call it and he cannot go back to work there and has no skill in a sedentary field What do we do? We have not received any workmen's comp since the release. Since this time we have had to use my work insurance to prove that there are still disk problems in his back that have not been fixed and he is still in almost constant pain from this. Can anyone tell us what options we have? Our attonery has not been able to, he wants this to go to trial.
