Worried sick over sherriffs small claims notice

My husband was employed with a sherriffs department in Ohio, where we lived at the time. He resigned in Sept of 99. He had signed something stating he had to complete a 2 year employment or pay $750.00 for the cost of his training. We don't dispute this. But resigned before his 2 years were up. We know that $750.00 has to be repaid. But, the sherriffs dept kept his last 2 paychecks. One was for a full two weeks and the other for 5 days of work. The deputies were also granted a retroactive pay raise that year, because we recd an addtl W2 in 2000 stating an addtl $300.00 in wages, even though he did not work for them in 2000. Confused yet? In Oct 2000 I sent a letter (not certified,duh) to the fiscal director asking for the amount owed to us after paying off the $750. I was never responded to. Then I recd a notice to appear in small claims, for you guessed it, the $750. Am I in big trouble? I have every document I could get my hands on.

Your post says that YOU received notice of a lawsuit. If this is correct, you are in no trouble at all, since you are NOT a party to the debt. Simply send the court a letter (certified RRR) denying any debt owed by YOU to the Plaintiff and ask that the plaintiff submit proof of YOUR debt.
You might also send a letter directly to the Plaintiff and ask that they provide some proof of YOUR indebtedness or, if they cannot prove YOUR debt that they file a non-suit in this matter.

Now, if the suit names your husband, that is a different matter.
